Move It Cheap Trailer Hire

1. Definitions

  • “Company” refers to Move It Cheap Trailer Hire.
  • “Customer” refers to the hirer of the trailer.
  • “Trailer” refers to any trailer or equipment hired.
  • “Hire Period” means the agreed rental duration.

2. Acceptance of Terms

By hiring a trailer, the Customer agrees to be bound by these Terms and Conditions.

3. Compliance with Australian Law

  • This agreement is governed by the laws of the relevant Australian State or Territory.
  • Nothing in these Terms excludes rights under the Australian Consumer Law (“ACL”).
  • Guarantees under the ACL cannot be excluded and include that goods are of acceptable quality and fit for purpose.

4. Eligibility Requirements

The Customer must:

  • Hold a valid Australian driver’s licence (or recognised international equivalent).
  • Be legally permitted to tow a trailer under applicable state regulations.
  • Ensure their towing vehicle complies with Australian towing capacity laws.

5. Booking, Payment, and Bond

  • Full payment or deposit may be required at booking.
  • A refundable security bond may be required prior to collection.
  • The Company may deduct from the bond for:
    • Damage
    • Late return
    • Cleaning or repair costs

6. Use of Trailer

The Customer agrees to:

  • Use the trailer only for lawful purposes.
  • Not exceed the Aggregate Trailer Mass (ATM) or load limits.
  • Properly secure all loads in accordance with Australian road safety laws.
  • Ensure trailer lights, brakes, and connections are functioning before use.

The Customer must NOT:

  • Sub-hire or lend the trailer.
  • Use the trailer for illegal activities.
  • Operate the trailer negligently or dangerously.

7. Customer Responsibilities

During the Hire Period, the Customer is responsible for:

  • Loss, theft, or damage to the trailer
  • Damage to third-party property
  • Any fines, tolls, or penalties incurred

8. Insurance and Liability

  • The Company may provide limited insurance coverage where stated.
  • The Customer is responsible for any excess payable in the event of damage.
  • To the extent permitted by law, the Company excludes liability for:
    • Loss of income
    • Damage to transported goods
    • Indirect or consequential loss

Nothing in this clause excludes rights under the ACL.

9. Pickup and Return

  • The trailer must be returned:
    • On time
    • In the same condition (fair wear and tear excepted)
  • Late returns may incur additional hire charges.
  • Cleaning or repair fees may apply if returned in poor condition.

10. Breakdown and Repairs

  • The Customer must notify the Company immediately in the event of breakdown.
  • Repairs must not be undertaken without prior approval.
  • The Company will provide reasonable assistance where possible.

11. Cancellation Policy

  • Cancellations may be subject to fees depending on notice period.
  • Refunds are at the Company’s discretion unless required by law.

12. Indemnity

The Customer agrees to indemnify the Company against any claims, damages, losses, or liabilities arising from:

  • Use or misuse of the trailer
  • Breach of these Terms

13. Termination

The Company may terminate the hire agreement immediately if:

  • The Customer breaches these Terms
  • The trailer is used unsafely or illegally

14. Privacy

The Company will handle personal information in accordance with the Privacy Act 1988 (Cth).
Customer information will only be used for business and legal purposes.

15. Amendments

The Company may update these Terms at any time. Updated terms apply to future bookings.
